In this article, we explore ethical perceptions of three product packaging issues as viewed by packaging professionals, brand managers, and ethically-interested consumers. We examine, differences between business practitioners and consumers with respect to ethical sensitivity, perceived consequences of business practices, and perceived industry norms. Additionally, we explore the prevalence of two types of values, pragmatic and moral, to determine if the use of these value-types differs among the three groups. We find that business practitioners exhibit less ethical sensitivity. Businesspeople also (...) feel that the likelihood and severity of negative consequences resulting from a packaging practice is lower than do ethically-interested consumers. Recent judicial rulings and changes in federal and state legislation have given for-profit corporations a growing list of rights and constitutional protections, including the right to practice religion free from many types of federal or state restriction. In this paper, we highlight the implications of these developments using Rawls’ Theory of Justice to explore the consequences of for-profit corporate religious freedom for consumers and employees. We identify preliminary principles to spark a discussion as to how expanding religious freedom for businesses (...) and fair access to goods and services can coexist in the for-profit marketplace. Avatars will represent us online, in virtual worlds, and in technologically supported hybrid environments. We and our avatars will stand not in an identity relation but in a proxy relation, an arrangement that is significant not least because our proxies’ actions can be counted as our own. However, this proxy relation between humans and avatars is not well understood and its consequences under-explored. In this paper I explore the relation and its potential ethical consequences.

Thomas Pogge's Global Resources Dividend relies on a flat tax on the use of natural resources to fund the eradication of world poverty. Hillel Steiner's Global Fund taxes the full rental value of owned natural resources and distributes the proceeds equally. The paper compares the Dividend and the Fund and defends the Global Share, a novel proposal that taxes either use or ownership, does so (when possible) progressively, and distributes the revenue according to a prioritarian rather than a sufficientarian or (...) egalitarian principle. There is growing evidence to support the claim that we react differently to robots than we do to other objects. In particular, we react differently to robots with which we have some form of social interaction. In this paper I critically assess the claim that, due to our tendency to become emotionally attached to social robots, permitting their harm may be damaging for society and as such we should consider introducing legislation to grant social robots rights and protect them from (...) harm. I conclude that there is little evidence to support this claim and that legislation in this area would restrict progress in areas of social care where social robots are a potentially valuable resource. Forgiveness is clearly an important aspect of our moral lives, yet surprisingly Kant, one of the most important authors in the history of Western ethics, seems to have very little to say about it. Some authors explain this omission by noting that forgiveness sits uncomfortably in Kant’s moral thought: forgiveness seems to have an ineluctably ‘elective’ aspect which makes it to a certain extent arbitrary; thus it stands in tension with Kant’s claim that agents are autonomous beings, capable of determining (...) their own moral status through rational reflection and choice. Other authors recognise that forgiveness plays a role in Kant’s philosophy but fail to appreciate the nature of this duty and misrepresent the Kantian argument in support of it. This paper argues that there is space in Kant’s philosophy for a genuine theory of forgiveness and hopes to lay the grounds for a correct interpretation of this theory. I argue that from a Kantian perspective, forgiveness is not ‘elective’ but, at least in some cases, morally required. I claim that, for Kant, we have an imperfect duty of virtue to forgive repentant wrongdoers that have embarked on a project of self-reflection and self-reform. I develop a novel argument in support of this duty by drawing on Kant’s theory of rational agency, the thesis of radical evil, Kant’s theory of moral development, and the formula of humanity. However, it must be noted that this is a conditional duty and Kant’s position also entails that absence of repentance on the part of the wrongdoer should be taken as evidence of a lack of commitment to a project of self-reflection and self-reform. In such cases, Kant claims, we have a perfect duty to ourselves not to forgive unrepentant wrongdoers. I argue that this duty should be understood as one of the duties of self-esteem, which involves the duty to respect and recognise our own dignity as rational beings. (shrink)

We examine the concept of personhood in relation to people living with dementia and implications for the humanity of care, drawing on a body of ethnographic work. Much debate has searched for an adequate account of the person for these purposes. Broad contrasts can be made between accounts focusing on cognition and mental faculties, and accounts focusing on embodied and relational aspects of the person. Some have suggested the concept of the person is critical for good care; others suggest the (...) vexed debates mean that the concept should be abandoned. We argue instead that the competing accounts illuminate the very tensions in personhood which are manifest for all of us, but especially for people living with dementia, and argue that our account has explanatory power in shedding light on how precisely dehumanisation and constraints on agency may arise for people living with dementia, and for staff, within an institutional context. Although G. A. Cohen's work on Marx was flawed by a lack of gender-awareness, his work on Rawls owes much of its success to feminist inspiration. Cohen appeals effectively to feminism to rebut the basic structure objection to his egalitarian ethos, and could now appeal to feminism in response to Andrew Williams's publicity objection to this ethos. The article argues that Williams's objection is insufficient to rebut Cohen's ethos, inapplicable to variants of this ethos, and in conflict with plausible gender-egalitarian (...) ethoses. The article also advocates an understanding of basic structuralism and publicity consistent with feminism, and argues that Rawlsians need not reject plausible domestic egalitarian ethoses on either publicity or liberty grounds. Can sentence comprehension impairments in aphasia be explained by difficulties arising from dependency completion processes in parsing? Two distinct models of dependency completion difficulty are investigated, the Lewis and Vasishth (2005) activation‐based model and the direct‐access model (DA; McElree, 2000). These models' predictive performance is compared using data from individuals with aphasia (IWAs) and control participants. The data are from a self‐paced listening task involving subject and object relative clauses. The relative predictive performance of the models is evaluated using k‐fold (...) cross‐validation. For both IWAs and controls, the activation‐based model furnishes a somewhat better quantitative fit to the data than the DA. Model comparisons using Bayes factors show that, assuming an activation‐based model, intermittent deficiencies may be the best explanation for the cause of impairments in IWAs, although slowed syntax and lexical delayed access may also play a role. This is the first computational evaluation of different models of dependency completion using data from impaired and unimpaired individuals. This evaluation develops a systematic approach that can be used to quantitatively compare the predictions of competing models of language processing. (shrink)

Claudia Blöser has recently proposed that Kant’s duty to be forgiving is grounded on the need to be relieved from the burden of our moral guilt, a need we have in virtue of our morally fallible nature, irrespectively of whether we have repented. I argue that Blöser's proposal does not fit well with certain central aspects of Kant’s views on moral guilt. For Kant, moral guilt is a complex phenomenon, that has both an intellectual and an affective aspect. I argue (...) that it is not even possible for us to fully overcome our intellectual guilt, and to the extent that it is possible to ameliorate our felt guilt, this is largely a matter of self-forgiveness. However, self-forgiveness is only appropriate when there is repentance for the wrongful action and rejection of its underlying immoral maxim by the wrongdoer as part of a project of moral transformation. I offer an alternative account of the human need for forgiveness, an account that makes forgiveness conditional on repentance. (shrink)

According to the authors of Populism and Civil Society, ‘populism is situated within the democratic imaginary’ but its logic is authoritarian. This article agrees with the first but challenges the second argument by focussing on the question of representation. In the case of ‘populism as government’ the tensions between bottom-up and top-down articulations seem to be more or less resolved by the repression of bottom-up organization, but in so doing, so the argument of this article, populism is mutating into something (...) else. Furthermore, ‘populist dictatorship’ seems to be closer to a dictatorship strategically using populist tools than to an intrinsic populist logic. While I agree with the authors on the authoritarian cases of populism in government, my argument diverges from the book when it comes to populism as government and introduces a discussion about the nature of populism. To this purpose, I first propose a complex definition of populism which understands populism not as the essence, but as one component of hybrid authoritarian formations, thus enabling the disentanglement of populism, authoritarianism, and totalitarianism. Second, I examine two components of populism that Arato and Cohen lay out in the book: the specific representation pars pro toto and embodiment. Building on Lefort, I argue that these components are not populist but totalitarian and that the empirical manifestations of populism are always hybrid, mixing populist and authoritarian or even totalitarian components. It specifically examines the role of microhistory within the history of science and the importance of Thomas Kuhn’s concept of the “normal exception” in early methodological statements about the function of microhistory. Consciousness has a peculiar affinity for presence; conscious states represent their contents as now. To understand how conscious states come to represent time in this way, we need a distinction between a mental state that represents now and one that simply occurs now. A teleofunctional theory accounts for the distinction in terms of the development and function of explicit temporal representation. The capacity to represent a situation explicitly as ‘now’ and compare it with past situations in order to prepare for (...) the future involves the separation of goals from the particular action required to attain them. That is, when a creature is able to consider alternative paths of action, it becomes necessary to conceive of alternate future times as distinct from the present moment. The developmental, functional approach of a teleofunctional theory is promising in its ability to integrate research from diverse empirical fields for support of its claims. (shrink)

Contrary to current individualistic epistemology, Classical rhetoric provides us with a pragmatical and particularly dynamic conception of ‘testimony’ as a source made available for the orator by the particular community in which she acts. In order to count as usable testimony, a testimony to which one could appeal in further communications, any discourse must comply with specific rules of social sanction. A deliberate attention to the social practices in which testimony is given and assessed may offer us a more accurate (...) view of its epistemological role. (shrink)

Stigma taints individuals with a spoiled identity and loss of status or discrimination. This article is the first to examine the stigma attached to abortion and surrogacy and consider how law may stigmatize women for failing to conform to social expectations about maternal roles. Courts should consider evidence of stigma when evaluating laws regulating abortion or surrogacy to determine whether these laws are based on impermissible gender stereotyping.

There are at least three senses of sexual objectification: the moral sense of treating a person as if she were primarily a sexual object, the political sense in which women socially count as instruments for men’s sexual pleasure, and the epistemic sense of forming a belief that a person is as one sexually desires them to be. These different senses have been treated as rivals, competing about what the correct account of sexual objectification is, or they have been treated as (...) entirely different projects. I argue for a third relation between them: each sense grasps an aspect of the existing social phenomenon of sexual objectification. Each further points out a wrong involved in sexual objectification. And the three aspects interact—we cannot fully explain any one sense of sexual objectification without the other two. To properly understand this interrelation I lean on an analogy: commodity fetishism as described by Marx helps make sense of the complex social reality of sexual objectification. (shrink)

This paper aims to provide new insights to debates on group privacy, which can be seen as part of a social turn in privacy scholarship. Research is increasingly showing that the classic individualistic understanding of privacy is insufficient to capture new problems in algorithmic and online contexts. An understanding of privacy as an “interpersonal boundary-control process” (Altman, The environment and social behavior, Brooks and Cole, Monterey, 1975) framing privacy as a social practice necessary to sustain intimate relationships is gaining ground. In this debate, my research is focused on what I refer to as “self-determined groups” which can be defined as groups whose members consciously and willingly perceive themselves as being part of a communicative network. While much attention is given to new forms of algorithmically generated groups, current research on group privacy fails to account for the ways in which self-determined groups are affected by changes brought about by new information technologies. In an explorative case study on self-organized therapy groups, I show how these groups have developed their own approach to privacy protection, functioning on the basis of social practices followed by all participants. This informal approach was effective in pre-digital times, but online, privacy threats have reached a new level extending beyond the scope of a group’s influence. I therefore argue that self-determined sensitive topic groups are left facing what I present as a dilemma: a tension between the seemingly irreconcilable need for connectivity and a low threshold, on the one hand, and the need for privacy and trust, on the other. In light of this dilemma, I argue that we need new sorts of political solutions. (shrink)

This article argues that correctional institutions violate the Eighth Amendment when they refuse to establish MAT programs and prevent doctors from exercising medical judgment to properly treat incarcerated people with OUD.

Background: Depressive disorder is one of the main health problems worldwide. Many risk factors have been associated with this pathology. However, while the association between risks factors and adult depression is well established, the mechanisms behind its impact remains poorly understood. A possible, yet untested explanation is the mediating impact of levels of personality functioning, i.e., impairments with regard to self and interpersonal.Method: Around 162 patients were assessed at the beginning of their therapy, with regard to risk factors, such as (...) sociodemographic, physical, hereditary, and adverse childhood experiences. Depressive symptoms and personality functioning were also measured. Associations between the related variables as well as other possible covariates were examined by means of zero-order correlations and bootstrapping-based mediation analysis.Results: Of all the risk factors taken into account, level of education and physical illness were associated with depression. On the other hand, the most significant predictor of depressive symptomatology was ACE, and this relationship was mediated by personality functioning. This indicates that patients presenting adverse childhood experiences are more likely to develop deficiencies in personality functioning, which in turn increases their likelihood of developing depressive symptomatology.Conclusion: These results reaffirm the importance of incorporating risk and vulnerability factors such as personality functioning in understanding depression. Introduction to special issue on justice and gender (in)equality in Law, Ethics and Philosophy.

Pantomime has long been considered distinct from co-speech gesture. It has therefore been argued that pantomime cannot be part of gesture-speech integration. We examine pantomime as distinct from silent gesture, focusing on non-co-speech gestures that occur in the midst of children’s spoken narratives. We propose that gestures with features of pantomime are an infrequent but meaningful component of a multimodal communicative strategy. We examined spontaneous non-co-speech representational gesture production in the narratives of 30 monolingual English-speaking children between the ages of (...) 8- and 11-years. We compared the use of co-speech and non-co-speech gestures in both autobiographical and fictional narratives and examined viewpoint and the use of non-manual articulators, as well as the length of responses and narrative quality. The use of non-co-speech gestures was associated with longer narratives of equal or higher quality than those using only co-speech gestures. Non-co-speech gestures were most likely to adopt character-viewpoint and use non-manual articulators. The present study supports a deeper understanding of the term pantomime and its multimodal use by children in the integration of speech and gesture. (shrink)

The aim of this paper is to carry out a comparative analysis of clauses in Polish and English copyright agreements in respect of their translation by a computer assisted tool—Google Translate, and to assess the quality of such translation. The comparison of parallel texts as a research method has been applied. The research corpora include authentic Polish and English Copyright Agreements. The analysed clauses have been excerpted from the above mentioned Copyright Agreements. The author chose the most standard clauses as (...) well as clauses typical for copyright contracts. As a result of the analysis, translations provided by Google Translate are better in terms of typical clauses but of worse quality in terms of specialised copyright clauses. (shrink)

After the Event Horizon Telescope Collaboration released in April 2019 the first empirical images of a black hole, an astrophysical object previously thought “unseeable,” much of the public discourse has approached these images as straightforward visual depictions of a black hole. This article challenges this view by showing that the first images of a black hole went beyond merely making an invisible cosmic object visible and that the images published in April 2019 were just the first in a series of (...) black hole images the researchers continue producing. Drawing primarily on Sybille Krämer’s concept of the cartographic impulse, the article demonstrates that the Event Horizon Telescope images are, first and foremost, epistemic tools. These epistemic tools enable researchers to actively explore various physical aspects and dynamic properties of a black hole’s immediate environment and test theoretical predictions about it, thus making this elusive environment empirically knowable. To demonstrate this, the article analyses the mapping operations that combined automated algorithmic procedures with expert human judgment and through which these images were produced, read, and interpreted. It also examines how the different Event Horizon Telescope images relate to one another, which particular epistemic functions they fulfil in the research context, under which conditions, and with which limitations, thus tracing how these images facilitate the production of new scientific knowledge about black holes. Vast archives of fragmentary structural brain scans that are routinely acquired in medical clinics for diagnostic purposes have so far been considered to be unusable for neuroscientific research. Yet, recent studies have proposed that by deploying machine learning algorithms to fill in the missing anatomy, clinical scans could, in future, be used by researchers to gain new insights into various brain disorders. This chapter focuses on a study published in2019, whose authors developed a novel unsupervised machine learning algorithm for synthesising (...) missing anatomy in extremely sparse clinical MRI scans of thousands of stroke patients. By approaching the study from a media-theoretical perspective, I analyse how its authors dis-cursively negotiated the anatomical and operative plausibility of the unobserved anatomy that their black-boxed algorithm reconstructed from the existing sparse data. My analysis fore-grounds the processual, relational, context-dependent, and essentially unstable character of the thus established plausibility of the algorithmically synthesised neuroanatomy. The college hookup scene is a profoundly gendered and heteronormative sexual field. Yet the party and bar scene that gives rise to hookups also fosters the practice of women kissing other women in public, generally to the enjoyment of male onlookers, and sometimes facilitates threesomes involving same-sex sexual behavior between women. In this article, we argue that the hookup scene serves as an opportunity structure to explore same-sex attractions and, at least for some women, to later verify bisexual, lesbian, or (...) queer sexual identities. Based on quantitative and qualitative data and combining queer theory and identity theory, we offer a new interpretation of women’s same-sex practices in the hookup culture. Our analysis contributes to gender theory by demonstrating the utility of identity theory for understanding how non-normative gender and sexual identities are negotiated within heteronormatively structured fields. In the future, it is likely that we will form strong bonds of attachment and even develop love for social robots. Some of these loving relations will be, from the human’s perspective, as significant as a loving relationship that they might have had with another human. This means that, from the perspective of the loving human, the mindless destruction of their robot partner could be as devastating as the murder of another’s human partner. Yet, the loving partner of a robot (...) has no recourse to legal action beyond the destruction of property and can see no way to prevent future people suffering the same devastating loss. On this basis, some have argued that such a scenario must surely motivate legal protection for social robots. In this paper, I argue that despite the devastating loss that would come from the destruction of one’s robot partner, love cannot itself be a reason for granting robot rights. However, although I argue against beloved robots having protective rights, I argue that the loss of a robot partner must be socially recognised as a form of bereavement if further secondary harms are to be avoided, and that, if certain conditions obtain, the destruction of a beloved robot could be criminalised as a hate crime. Philosophical theories of memory rarely distinguish between importantly different sorts of memory: procedural, semantic and episodic. I argue for a temporal representation theory to explain the unique characteristic of episodic memory as the only form of conscious memory. A careful distinction between implicit and explicit representation shows how the past figures in memory. In procedural and semantic memory, the influence of the past is implicit by which I mean that the past experience is used but not represented in the skill (...) or knowledge. Episodic memory, in contrast, depends on representing a past experience as past. On a temporal representation theory of consciousness, a conscious state represents the present moment, and in the case of episodic memory, it includes a representation of past experience. The embedded account of the ‘feeling of pastness’ takes past experience to be part of the explicit content of a conscious state. An episodic memory is a representation of the present that includes a representation of the past. Whereas a higher-order theory of consciousness can give no reason why only episodic memories are conscious, a temporal theory explains why episodic memories are both higher-order and conscious. Finally, I consider the essential role of episodic memory in the formation of a temporally extended self. The demands of a social environment motivate development of an ability to track the mental states of others and oneself over time. By incorporating past experience (and future experience) into the present, episodic memory extends experience in time to form the sense of self. Through a careful examination of the function of temporal representation, we can see why the past is not consciously represented in procedural and semantic memory and the value of consciously representing the past in episodic memory. Cook (forthcoming) presents a paradox which he says is not circular. I see no reasons to doubt the non-circularity claim, but I do have some concerns regarding its paradoxicality. My point will be that his proposal succeeds in offering a formalization, but fails in providing a formal paradox, at least of the same type and strength as the Liar. Cook (en prensa) presenta una paradoja que según él no es circular. No veo motivos para cuestionar la pretensión de no circularidad, (...) pero sí me resulta algo problemática la cuestión de su paradojicidad. El punto que intentaré defender será que la propuesta de Cook es exitosa en ofrecer una formalización, pero fracasa en proveer una paradoja formal, al menos del mismo tipo y fuerza que el mentiroso. The aim of this paper is to discuss the status of the “personal” character of Nietzsche’s philosophy, taking as a starting point his late reflections on suffering, especially in the prefaces of 1886 and in Ecce homo. Initially, a contrast is presented between two extreme interpretations regarding the allegedly autobiographical character of his thought, the one of Lou Andreas-Salomé and the other of Paul Loeb (1); more moderate solutions than previous ones are analyzed, especially those of Werner Stegmaier and Michael (...) Ure (2); it is discussed, taking as reference notions or guiding ideas of his philosophy, such as suffering (3) and psychology, in which the “self-psychology” of the “subject” Nietzsche (4) consists; and it is indicated, conclusively, how these conceptions make room for thinking about their importance in contemporary discussions about the subject and the processes of subjectivation (5).
